Resident Proposed Amendment

Just to update, the Amendment to the Bylaws that was proposed by the Board did not pass. However, there is a Resident Proposed Amendment on which owners can vote. The main difference is that the phrase about assessments being subject to the discretion of the Board has been deleted. Below, you will find a copy of the Resident Proposed Amendment as well as a short explanation of what the amendment means. If you would like to vote for the amendment, there are copies of the Ballot itself as well as copies of a proxy on Jennifer Breece's door at 11605, Unit D. Please just drop them in the manila envelope that is hanging on the door. The deadline is 6 pm on December 15, 2011. TOMAHAWK CREEK CONDOMINIUMS

RESIDENT SPONSORED AMENDMENT TO THE DECLARATION AND BYLAWS

December 15, 2011


The Bylaws Article II. Section 7. and the Declaration 8. and Exhibit B state that each unit shall be entitled to a weighted vote. A Unit may vote in person or by proxy. In no event shall more than one vote be cast with respect to any unit.


PROPOSAL TO AMEND THE DECLARATION AND BYLAWS AS FOLLOWS:


  1. Section 9(a) and (c) of the Declaration and Sections 1 and 2 of the Article VI of the Bylaws are hereby amended to provide that all Common Expenses hereafter incurred (including those for Limited Common Areas and Facilities) shall be assessed against all Units in accordance with each Units percentage interest as set forth in Exhibit B of the Declaration; provided, however, any Common Expense incurred as a result of an act or omission of a Unit Owner, its tenants, or any invitee, agent or contractor of the Unit Owner or tenant, shall be assessed against the Owner’s Unit(s).

  2. Section 9(b), i, ii, iii are hereby removed from the Declaration.

  3. Except as provided herein, all terms and conditions of the Declaration and Bylaws, including without limitation, Section 9(a) and (c) of the Declaration and Article VI of the Bylaws, are hereby ratified and shall remain in full force and effect. This amendment shall benefit and bind the Association, the Unit Owners and their respective successors and assigns. Any capitalized terms not defined herein shall have the meaning ascribed to them in the Declaration and Bylaws.

Hello Neighbors,


I wanted to provide all of you with information regarding the amendment that the community can vote on. The bullet point that is highlighted in blue is how the resident amendment differed from the board amendment.


Resident Sponsored Amendment:

  • All Limited Common Areas are covered by HOA dues

  • Removed clause that gives a board the power to assess fees of Limited Common Areas as they deem necessary (section 9(b) in the Declaration)

  • Will provide relief to residents in building 18, instead of only building 18 residents paying for the work. All residents in the community will be assessed a ONE time special assessment according to your percentage of interest. An example of the cost would be a 1 bed, 1 bath on the bottom floor would be assessed $290 (please see below for more details).


I also want to explain that this amendment does not only help the residents in building 18 but ALL residents. If another building has issues then the same assessment of fees will be followed. The future boards would not have the discretionary action to assess only those impacted but would rather have to assess the community as a whole.


The amendment also helps out the residents in building 18. Building 18 has foundation issues, which has amounted to $140,000. Each resident in that building is being assessed $10,000 to $14,000. If the amendments passes, then the community as a whole will be assessed rather then just building 18 residents. It will be a ONE time assessment based on your percentage of interest. This assessment does not change your monthly dues, it would be a ONE time additional cost. However, if neither of the amendments pass then the residents in building 18 will be responsible for the whole amount. It also means if your building has any issues you and the residents in your building will be responsible for the bill rather then the community.

Holiday Times Are Here

Hello!

Thanks to all who came out for the pet parade! I hear it was a success, and fun was had by humans and pets alike!

Here are some upcoming dates to keep in mind:

November 11th is Veterans Day, a good day to thank a veteran. Or if you are a veteran, to be thanked. All the Hy-Vees are having a thank-you breakfast from 6 - 11 am in which veterans eat for free. If you wish to accompany a veteran, but you are not one yourself, you are still welcome; the cost is a la-carte and is about $3.99 for a regular breakfast.

November 17th is a regular Board of Directors meeting. They always start at 6:15 pm and are held in the clubhouse.

November 24th is Thanksgiving - yay! The office will be closed that day.

December 3rd is our holiday party! More details will be forthcoming.

December 15th is our annual meeting. It will start at 7 pm in the clubhouse. It is at this meeting that we elect new members for the Board of Directors. If you can not be there in person for any reason, please sign a proxy form. You can do this any time by stopping by the office and talking to Leslie. Please have in mind a person you to whom you would like to give your proxy.

Please be aware that the vote regarding the amendment to the By-Laws must be turned in by Thursday, October 20th.

Other notes regarding the vote:
1. The ballot must be turned in to the office in person.
2. Leslie has copies of the ballot, in case you don't have one.
3. If you can NOT get to the office in person, you can send in a proxy.
4. If you have questions regarding the vote, feel free to ask a Board member.

Another important date:
1. The Annual Meeting is when we elect the Board members.
2. It takes place on Thursday, December 15th, 2011, at 7 pm in the clubhouse.
3. If you can NOT attend, please fill out a proxy form, which you can get from the office.

Yet another important date:
1. Interested in running for the Board of Directors? Please fill out an application.
2. The application may be obtained from the office.
3. The application is due Wednesday, November 23rd, 2011.

Illegally Parked Vehicles

Herein lies the problem:
All drive lanes in Tomahawk Creek are fire lanes.
If a car is not parked in an actual parking space, emergency vehicles can not get through in the case of an emergency.
However, it costs the owner of the illegally parked vehicle a small fortune if his or her car gets towed.
Therefore, many residents are hesitant to call the towing company on illegally parked vehicles.

Here is a solution:
The police can be called instead.
They will issue a parking ticket, which is about two hundred dollars LESS than a tow. (It's $45.)

When calling the police, please remember:
Dial the NON-emergency number, 913-642-7700.
Tell them the make and color of the car and where in the complex it is parked.
You do not have to leave your name.

Note: The painters (Solution Systems) are keeping their cars and trucks close to where they are working. If an emergency occurred, they would be available right away to move them if necessary. This writer asks that you not call the police on them.

Fall Is Coming

Fall is just around the corner - September 23rd is the first day of Fall this year. Unfortunately, Fall came to our pool early this year due the cryptosporidium outbreak in Johnson County. Cryptosporidium is a parasite that has infected quite a number of pools in Johnson County. It causes serious illness and possibly death. It is insidious in that it has a incubation period, where the person is carrying and shedding the parasite, during which the person does not show symptoms. Want to find out more? There is an article in last Wednesday's (8/31/11) Kansas City Star, Johnson County section. Also, there is a copy of the letter from the Johnson County Health Department on file at our office. The pool deck is still open, however, and will remain so until the weather turns.

But enough about parasite-infected pools! We have some upcoming social events. Please see the newsletter for a listing. Didn't get the newsletter? You can either pick up a copy in the mail room, or you can have one sent to you via email by contacting Leslie at tomahawkcreek@kc.rr.com. Some things to consider as the year comes to a close:

1. A number of Board members are finishing out their terms this December. They include Don Lickteig, Gayle Voyles, and Joseph So.

2. If you are interested in running for the Board, please contact Leslie for an application. Although anyone can be nominated from the floor on the day of the December Annual HOA meeting, you will not have a chance to have your application printed and distributed to the home owners unless you file 30 days in advance of the meeting. The Annual Meeting falls on December 15th this year. Please keep in mind that the application deadline therefore falls on November 15th, i.e. next month!

3. Are you changing your window or exterior doors as winter approaches? Please be sure to file an improvement application at the office. Not only are improvement applications required by the Architectural Guidelines, but you could also get some helpful tips from Leslie when you stop by, such as the following:

a) The unit letters on the exterior doors are NOT replaceable. No new ones may be ordered because they are no longer manufactured. Please remove the placard very carefully. Also, re-glue the placard with a strong glue or else it could fall off and break. This writer's husband recommends using a construction adhesive.

b) The knocker/eye hole hardware is also NOT replaceable, as it is no longer manufactured either. Saving this as well as all your door hardware will make the project much easier.

c) It is this writer's experience that Home Depot does NOT carry identical exterior doors to the ones we currently have. Since your new door must be exactly the same as the old one, you can either custom order a door from Home Depot or just go to Lowe's. Lowe's carries these doors, and the order number can be obtained from Leslie.

Reminder: The office will be closed on Labor Day, 9/5/11.

Various Announcements

Hello!

Please know that if you have a key to your unit on file with the office, it will be disposed of on August 19th if not picked up before then.

Fobs to access the pool area are available to be picked up by owners now. Come any time during regular business hours (M-F 9-6).

Any attachments to the building structure (screws or nails, for example) must be removed forthwith, and the holes must be patched appropriately. The problem with the holes is that they are allowing water to get inside the structure and contributing to our (ongoing and expensive) wood rot issues. Leslie will be around soon to make sure all the holes have been repaired.

There have been some problems with parking. All cars must be parked in a proper parking space, not in the drive lanes against the curbs. The reason this is so important is because we have such narrow drive lanes. As a result, emergency vehicles cannot get past any cars that may be parked against a curb; there is just not enough room. Please let your guests know where the visitor parking is located.

The next HOA meeting is September 15th at 7 pm in the clubhouse.

On a happy note, there are a bunch of social events coming up in August. Game nights are the 16th and the 25th from 7 - 8:30 pm in the clubhouse. Changes to the Declarations and By-Laws

A message from the President of the Board follows:

Thank you to those of you who attended the HOA quarterly meeting on June 16th. The Board is pleased and encouraged by the interest and comments of so many owners. We have had many, many discussions on possible amendments to the Declarations and By-laws and your input has been helpful.

The Board has since met and made some initial decisions on how we will proceed. A committee has been selected to research what we think to be needed changes to the Declarations and By-laws. The committee, made up of Gerald Clamors and Gayle Voyles, Board members, and Linda South, Covenant Committee Chairperson, will define what appears to be the needed changes and will present them to the rest of the Board for clarification. The proposed changes will then be reviewed with all of the home owners, who will then have the opportunity to further voice their opinions. Then, if needed, revisions will be made, after which a date and time will be set for voting.

Please keep in mind, the only way any changes can be made is with a vote of 67% of the owners approving any change. Please remind your neighbors to participate if they are not yet involved.

Bugs?

You may be wondering whether we spray for bugs. The answer is "Yes!" However, routine spraying is done on the OUTSIDE of the buildings only. Here's the good news: If you want the exterminator to come inside your unit, you can call Leslie to help set up an appointment. The exterminator is here on Wednesdays.

This service is part of our extermination contract and is therefore already covered by our HOA dues. Yes, that's right - you can call the exterminator at NO extra charge. So please don't call an exterminator yourself - it's already covered!

Last week's Pool Party

Fun was had by all! (At least I hope so!) We had great food, both catered and home-made (thank you, all you cooks!). Some took advantage of the volley ball net spanning the pool. Many neighbors got to meet new neighbors and chatted it up. If you RSVP'd before June 7th, you were entered in the drawing for a $25 gift card, which Becky Paris won (congratulations!). Approximately 50 people RSVP'd and even more attended, so we had a wonderfully attended party! Mother Nature smiled upon us, too - the weather was just beautiful. Thanks to all who worked to make this a successful event!! And check back later - I will hopefully be posting a few pictures!

More Details on Bulk Trash and Donations!

THIS weekend is our big bulk trash and donation weekend. We have learned that not all bulk trash will be picked up by Town and Country. In fact, if anyone has trash still sitting on their curb on Monday, the City of Leawood says that they will assess a fine to the owner of the trash. We don't want that!

Here is a list of what the charities WANT:
Couches, chairs, love seats, tables, end tables
Refrigerators, washer/dryers, stoves, dishwashers
Beds, bed frames
Vacuum cleaners, stereos, electronics, microwaves, TVs, PCs

Here is what will NOT be picked up by Town and Country:
Liquids, glass
Hazardous Waste, paint, pesticides, chemicals, oils
Clothes (!)
Car batteries, tires, automotive parts
Construction materials, concrete, dirt, old lumber, fencing, shingles
Basketball poles

So what's a person to do if they have some of these things that Town and Country won't pick up? Never fear! The dumpster will be here!

Yes, it's true. Since Town and Country's list is so long of things they will not pick up, we are going to have the dumpster set up near the tennis courts. It will appear on Saturday and disappear sometime Monday morning. (So be sure to get all your trash in by the end of Sunday.) Remember, however, that there are also restrictions on what can be put in our dumpster.

Here is what can NOT be put in our dumpster:
Hazardous waste of any kind (like paint, pesticides, chemicals, oil)
Batteries

To arrange for disposal of these last items, please call Johnson County Hazardous Waste at 913-715-6900.

So what CAN go in our dumpster? My family plans to throw away a hopelessly destroyed washing machine as well as some construction materials like pieces of drywall and lumber.

Please know that, according to the City of Leawood, any items left out, like bikes, grills, and toys WILL BE PICKED UP by the charities or Town and Country. So please don't leave out anything you want to keep!!!!

Where's The Dumpster?

So yesterday, the bulk trash dumpster was scheduled to be here. But it's not! Inquiring minds (or people with lots of bulk trash) may ask "Why?". The reason is exciting. Saturday, June 4th, we are invited to put all of our unwanted bulk trash, as well as any items we may wish to donate, out on the curb. Charity trucks will be going through the neighborhood and will pick up any items they feel they can use. The very next day, the City of Leawood is sending a Town and Country Disposal truck through the neighborhood to pick up anything that is left. This is a free service for us, whereas we would have had to pay for the bulk trash dumpster. Plus, it's curb-side service!

Pool and Clubhouse Happenings

Just a quick update to let you know that the pool will be open THIS Friday, May 20th! The updates and new landscaping are just about finished. I would like to thank Leslie for volunteering to water the new hanging flower baskets every day.

The pool party will be on Saturday June 11th. It should be very nice, so please pencil in this date on your calendars. More details on this later.

Leslie makes coffee every day down at the clubhouse, and there are tea bags for us tea drinkers, too! Today I stopped by and had a yummy lemon tea cookie as well. The clubhouse is ours to enjoy, so don't hesitate to hang out there or just drop by!

Welcome, Spring!

Hello all!

"April showers bring May flowers!" So for you gardeners out there who make our property so attractive, consider the following: Do you have time to donate to the landscape committee? If so, contact Don, the President. Also, don't forget that those beautiful May flowers need to be planted in containers, not directly in the ground.

Speaking of guidelines, new ones have been formulated by the Architectural Standards Committee in conjunction with the Board, and they will be sent out to every home owner very soon. If you have any questions, or didn't get a copy for whatever reason (perhaps you're a renter, for example), please contact Leslie down in the office.

Did you know that the tennis court can be reserved? Contact Leslie. The tennis and sports courts are open until 10 pm. If you are in the tennis or sports court, but not actually playing ball, just remember that no skateboards, scooters, or Rollerblades are allowed - the high amount of pressure on those small wheels tears up the surface, and that surface is quite costly to repair.

The weather seems to be gradually yielding to warmer temperatures. And with warmer temperatures comes (drum roll, please) the opening of the pool! Currently, our pool is getting a new concrete deck and new landscaping. Yay! When this work is finished, a notice will be posted. Start looking for this notice around the middle of May.

The other big thing we do in spring is spring cleaning. Yuck. But since it must be done, the bulk trash dumpster will appear to help you with your cleaning needs. It will be in the parking lot near the tennis courts (because this is a central location) from May 27th through June 6th.

Finally, an FYI: every month, Tomahawk Creek Condos puts out a newsletter. Since this contains important items that might not necessarily appear here, please make sure you read it. You can get it delivered straight to your email in-box by simply giving Leslie your email address. Alternatively, you can pick it up in the mail room, but since they are very popular, they sometimes run out.

Meetings and Greetings

Hello all!

Here comes the Spring Quarter HOA meeting! It is on Thursday, March 17th at 7 pm. Come to listen and be listened to!

But wait! There's more!

Come to the "Meet and Greet" beforehand at 6 pm! We have a new management company, Signature, and they are going to throw a little party for us (yes, with food and drinks!) so that we have a chance to get to know them. You may have already met Leslie in the office, but you may not have met Samantha, or Sam as she is called, our new property manager. Either way, come relax, talk, maybe share some goals or ideas you have for the property.

Due to the Meet and Greet, the Board of Directors meeting for March has been moved from its regular time of the third Thursday of the month at 6 pm, to Tuesday March 15th at 6 pm. Everyone in the community is welcome to come and observe.

We are in need of people to serve on committees. Maybe you want to achieve a certain goal for the property, but don't feel you have the time to serve on a long-term basis. No problem! You are most welcome to serve on an ad hoc basis! Or perhaps you have tried to get things done in the past, but have felt unheard. Please don't let this deter you; please try again. The community needs YOU, because you ARE the community!

Happy New Year - Welcome Signature - New Board Members

Happy New Year and Welcome Signature Property Management and New Board Members!

As you have read in the letters that have been sent to you, Tomahawk Creek Condominiums are now being managed by Signature Property Management. Signature has taken the place of The Tiehen Group.

You will be seeing some new and old faces around the property. In the office is Leslie Champion, the new on-site property manager. Around the property you will still see Bill Gates, our maintenance guy. Also on property from time to time will be Samantha Gwin, Regional Property Supervisor. A meet and greet with all the employees will be set up soon. Stay tuned.

If you have any questions about online dues payment, please call Leslie Champion in the office at 913.663.1103. She will happy to help you set up payments.

The community elected two new board members at the annual meeting. Please welcome John McKelvey and Gerald Clamors to the board. You can meet John and Gerald at the first board meeting on January 20, 2011. All board meetings are open to residents and take place the third Thursday of the month at 6:15 p.m. in the clubhouse.

Tomahawk Creek also has a social committee, a nominating committee, a landscape committee, a computer services committee, the covenants committee and the architectural standards committee. Some of these committees are fully functioning and some are not. New members are always welcome. Join for a year, or just join for one project. Either way, your involvement is appreciated. Watch the bulletin board and newsletters for meeting information on these committees.
